ADVICE FROM A LAW GUARDIAN
If a client of yours is in a custody battle and a Law Guardian has been
assigned to represent the child, here are some guidelines to suggest to your client:
1) Do not discuss the case with your children;
2) Do not talk derogatorily about the other parent;
3) Do not tell your child what to tell the Law Guardian, the Judge, the
evaluator, etc.;
4) If your child wants to speak to the Law Guardian, let the child use
the phone or help make an appointment and give privacy during any conversations with the
attorney;
5) Do not ask the child what he/she told the Law Guardian. This is
confidential and the child is entitled to privacy.
6) Do not call the Law Guardian about your case, call your own
attorney. I only accept calls having to do with my client. The record is sealed and kept
confidential. If your child faces an in camera interview let the Law
Guardian prepare his or her client and explain this process.
7) If the child is 13 years of age or older, they should call the Law
Guardian directly. There is no need for you to call.
8) Do not try to convince or persuade the Law Guardian you are the
better parent. I always regard this suspiciously.
9) Have your child speak to a professional therapist during this
stressful time, particularly if you notice any personality or behavior disorders.
10) Do not ask the Law Guardian what the child said to her as the
conversation are privileged.
One final thought: A child is blessed with
only two parents, a mother and a father. A child should be able to love, respect and have
positive feelings about each parent and continue a healthy relationship with each. DO NOT
take that away from the child.
